A St. Louis Park officer has asked a judge to dismiss a wrongful death lawsuit after a he shot a Marine in 2009.
According to police, the Marine was shot and killed near the police station after the officer attempted to pull him over for driving erratically. The police officer stated that the Marine attacked him and he shot him while trying to protect himself.
The Marine died of the gunshot wound. The mother of the Marine filed a wrongful death lawsuit, but the police officer asked the lawsuit to be dropped because it was a self-defense issue. A hearing has been set for May.
