A judge has reaffirmed $90 million in a $91.5 million nursing home abuse lawsuit that was filed by a family member after the death of their mother in Charleston nursing home.
A man filed the lawsuit after his 87-year-old mother died after living in the nursing home for three weeks in 2009. The woman suffered from Alzheimer’s disease and several other ailments, but was able to walk and speak when she was admitted.
After being in the nursing home for three weeks, she became dehydrated and confined to a wheelchair. She died shortly after. This settlement was affirmed even though it was over the medical malpractice lawsuit cap because the jury found that only 20 percent of the woman’s death was medical.
