Tracey Morgan has been in the news in the last few months after his limo was struck by a Wal-Mart truck, killing comedian James McNair and injuring Morgan and two other passengers.
After seeing the damage costs from the accident, Morgan and three other plaintiffs have decided to sue Wal-Mart for responsibility of the crash.
On June seventh, Morgan and friends were heading to New York City after a comedy act in Delaware. On a New Jersey turnpike, the truck was travelling at 20 mph over the speed limit and rear-ended the limo, according to CNN.
Morgan was in critical condition for several weeks for a broken nose, several broken ribs, and a broken leg. He was released from a rehabilitation center mid-July but will be undergoing aggressive rehab for months to come.
CNN reported that the lawsuit was filed in the US District Court of New Jersey. It states Wal-Mart was negligent in the ownership and operations of the truck. It is believed that the truck driver, Kevin Roper, fell asleep behind the wheel right before the accident.
Roper reported to a distribution center in Delaware after traveling 700 miles from Georgia, which should take eleven hours. The case states that Wal-Mart was being negligent when they made Roper continue driving after such a long drive. Roper could have reported to a closer location so he had time to sleep and rejuvenate before his next trip.
Prosecutors on the case are charging Roper with vehicular homicide and assault by auto, and he has pleaded not guilty.
The three other plaintiffs with Morgan are another comedian, Ardley Fuqua Jr. or “Ardie”, Morgan’s assistant, Jeffrey Millea, and his wife, Krista Millea. Ardie and Jeffrey Millea were also injured in the accident. Millea’s wife was not in the crash, but was eight months pregnant when it occurred and suffered from her husband’s absence afterwards, according to New York Times.
